"A federal judge on Wednesday overturned a California ban on same-sex marriage, ruling that the Proposition 8 ballot initiative was unconstitutional.

 

The ruling by U.S. District Judge Vaugh Walker, one of three openly gay federal judges in the country, gave opponents of the controversial Proposition 8 ballot a major victory.

 

Gay couples waving rainbow and American flags outside the courthouse cheered, hugged and kissed as word of the ruling spread.

 

Despite the favorable ruling for same-sex couples, gay marriage will not be allowed to resume. That's because the judge said he wants to decide whether his order should be suspended while the proponents pursue their appeal in the 9th U.S. Circuit Court of Appeals. The judge ordered both sides to submit written arguments by Aug. 6 on the issue.

 

Supporters argued the ban was necessary to safeguard the traditional understanding of marriage and to encourage responsible childbearing.

 

 

California voters passed the ban as Proposition 8 in November 2008, five months after the state Supreme Court legalized gay marriage."

The people of California vote to ban gay marriage and the court is undoing the will of the people. This is a huge step back just like Obamacare, which the people also don't want.

 

The people of California voted to make the law unequal because their religious prejudice prevents them from accepting those who arent them. As far as I'm concerned, Proposition 8 should have never been and the people of California made a terrible decision that is finally being undone.

The people of the state voted against gay marriage, the court is going against the will of the people. There is a huge problem with that. I couldn't care less about gay marriage, it does not affect me in any way. What affects me is the government going against what the majority of citizens voted for.

The way I see it, the will of the people shouldn't form a huge divide in it. Try being a gay man who has to sit there watching his straight friends walk down the aisle while wishing he could do the same. I'd say its rather depressing. Sometimes its not about the legal aspect. Some just want the experience.

Btw, when rights can be voted away by majority rules then they're not rights, they're privileges. And the last I checked, the Constitution states that all men are created equal, and are endowed with inalienable rights.

Yeah I acknowledged that someone might feel that way. But yeah I really want to know who fits in this circle of "will of the people". I've had a lot of laws go into place I wasn't exactly cool with. A line has to be drawn somewhere.

Why it is a step back? It would be step forward or a step clother to other more developed countries in the world. Universal healthcare isn't luxury, it's basal. The whole world is laughing about the US, because some americans haven't access to a family doctor. That's embarrassing, do the GOP notice that?

There was a right taken away. Before the passing of Proposition 8 the California supreme court ruled that gays had the same right to marry as straight couples.

There are many sources. You can check the facts yourself, it is a mix of Wikipedia, CIA World Factbook, UN, gov and research institutes statistics.

Oh and Sweden has "Obamacare" or universal healthcare and that's the reason why they live longer and are more height. But you are against universal healthcare! For europeans Obama is too far conservative and right and you say that he is a socialist, because he wants to introduce something that is basic standard here. I can't stop laughing about the tea party movement, that is ridiculous.

this is a bunch of bull. We are wasting money on this crap that keeps going in circles over and over. Lets face it., I dont buy for a minute that a majority of these people are born gay. Scientists STILL cant prove its something you are born with. Its all learned behavior/psychological disorder. :tdown: to gay behavior and marriage. The male was meant to be with female. Its HUMAN NATURE, thats the way we were born. Religion has no say in it etc.. Its ALL part of natural design. People saying I was born this way is BS totally. I dont buy it one bit. Its like trying to ram a square peg into a circle hole. WIth enough determination it can be done but it wasnt meant to be naturally.

 

More of our tax dollars flushed away for idiotic causes.

Yes, but it's necessarily since banning the right to marry whoever you want in California denies everyone equal rights and is therefore unconstitutional. It's the same thing as if the people of a certain state denied the right to interracial marriage, which we all think is BS now since that's implying some sort of racism against a certain group of people (that they shouldn't marry someone of higher/lower class). Even if these people would vote to pass a bill banning interracial marriage, the government would have to repeal it since it's unconstitutonal.

Humans aren't perfect, some people are disabled some are gay, because they are born with a genetic failure, that's fact. The question is, let we live them their life or not. In the middleaged religion of islam they may not. I thought that you are against islam.

You bring up that you think I am against islam. I am against all religion.

 

Its not a genetic defect or "failure" as you put it. For decades and decades scientists have been trying to figure out if it is a birth defect or not and With our advancements in technology,science and medicine, to this day they still have not found or published any evidence so anyone saying otherwise is just guessing.

 

This is a waste of our money to be bringing this up in court all over the country month after month.

 

Until the science field can actually prove its genetic and not psychological I dont support it one bit. Its a choice and one that I dont agree with and I dont think its acceptable behavior. You dont go around encouraging bi polar people to act erradically and not take their medication, same goes for this.

 

Thats why it is still regarded as "SEXUAL PREFERENCE" because it is a choice.

whos hiding behind institutions? fact of the matter is they cant prove any genetic or chromosome disorder. If they did then thats a completely COMPLETELY different situation entirely. To add on this point, sure some of you are in favor of the judge turning over the votes because it's something you agree with, but on a hypothetical:

 

What if this was like a north eastern state where the voters WANTS gay marraige and they voted IN FAVOR of it, but the judge decides to deny the measure and thus blocks gay marraige there. Would you all be in favor of that?

 

So this is not just anti-gay marraige. This is about one judge that can overturn the 'will of the people'. It may not happen now, but I'm not saying it can't happen. So if this is going to be a precedent, then all I will say is "be careful what you wish for".

 

For the record, I'm neither against gay marraige nor for it = neutral on it.

 

Just my 2 cents.
