In favor of most of the article, coming from a driver of course.

 

On the 'right of way' debate:

Most drivers I've encountered do give the right of way to pedestrians. Though from my own experience, pedestrians violate their rights way too often. Examples would be in Chinatown, Manhattan. The pedestrians just cross without even a green light causing a lot of cars to force-stop and delay other drivers.

 

Another note is when I first took lessons, I was actually told to stop once the pedestrian steps off the curb no matter which side he/she is coming from. It's probably different now but that's how I usually handled it. Unless of course the street is wide enough and I know I can make the turn without disrupting the pedestrians safety, I would just make the turn. (ie. Avenue U making the right to Ocean Ave)

 

Jay-walking victims are a tough one. I feel in most cases the motorist are to be blamed here, but I totally disagree. In other threads, I've pointed out that what if a person that 'jay-walked' dashed out the street without looking and gets struck? The motorists will not have the adequate time to stop. Which brings me to your last point that everyone should be aware of their surroundings and that safety should be EVERYONE'S responsibility.

I said it before, I'll say it again... people need to realize safety starts with you. Some people holler and cry about safety, only to do the same things they bitch about. You can't have it both ways.

I'm not sure which part you totally disagree with.

 

What peacemak3r is saying is that many times pedestrians would walk right out of the street not realizing that a car is coming ( or disregard that a vehiche is approaching ). The driver of the motor vehicle meanwhile needs a considerable distance to be able to come to a complete stop depending on the speed he is going at, if the jaywalker is in his path.

 

Depending on the response time of the driver, speed and the distance between the vehicle and the pedestrian if the motorist does not see the pedestrian in time he will not be able slow down to a complete stop immediately from when he or she slams on the brakes. Impossible.

 

Which is why the pedestrian should understand the concept of physics and spacial distance when crossing the street, if not then yeah prolly said pedestrian should wait for the light instead of walking right into traffic like they are built out of steel like superman thinking they will not get struck by a car.

 

For the motorist it can get pretty annoying esp when they are doing everything they can to obey traffic saftey rules on their end when pedestrians cant even use simple common sense when crossing a street.

Still confused. I agree that a pedestrian can cause an accident by stepping out in front of a car not giving him time to stop. What is the disagreement?

 

I believe what he is getting at is that with traffic saftey laws too much liability is placed on the motorist. I'll stop here and let him speak for himself.
