A homeless man who wandered onto subway tracks has been awarded $1.9 million after a jury found the York City Transit Authority 40% at fault in an accident that severed the man's foot.

Robert Obey's lawyer told the Daily News that Obey "could not remember how he wound up on the tracks,” at the 33rd Street Station in Midtown in 2006. Obey had just left a methadone clinic hours before the accident.

The train's operator waited until they pulled into the next station to report the incident. According to the Daily News, Obey was "high on drugs" when he was hit by the train and noted that Obey has a history of mental illness. The MTA will appeal the decision.

A recent perceived surge in subway deaths has led to more precautions being taken by the MTA as well as an awareness campaign about the dangers of going on or near the tracks. You can check out Gothamist's interactive map to see where injuries and suicides have happened most in the NYC transit System.

This story is crazy, I just hope he invests the money he's getting wisely.

It's no business of mine as to what people do with their money, but for his sake I hope he does.

It bad enough many are dismissing him as a typical junkie and all.

Sure people will dismiss him as a typical junkie as they love to look down on others in their narcissism, not surprising. However the grand jury didn't and here he is, a millionaire. Well I hope he uses the money wisely as well, to turn his life around from being a homeless drug addict into a successful man in life. This is the time for him to use the opportunity to get his shit together.

God only knows what the T/O was thinking...you hit somebody and keep going?

We don't know the full story here... Maybe the T/O didn't know until after the fact... I think some details are missing here as to why this person was awarded 1.9 million dollars, but thank God the (MTA) is appealing the decision.  Too many pay outs that comes back to bite the paying public in the @ss.

That's something to consider as it happened before.

In 2011 a young girl was run over by 11 sets of cars on the (N) near my area. None of the train crews were aware after the poor girl ended up on the tracks and killed. This caused a shitstorm of infighting within RTO division. The T/O was suspected of not following the SOP as when the girl fell she tripped the initial set of subway cars into emergency, yet the T/O did not search carefully enough to realize that this was a 12-9 and not a simple trip cock.

Could that be the case here? I am not sure.

Yes, but not at all shocking...  <_<

Indeed.

Though, of course, same ideals as other people, I hope the man can use the money to turn his life around despite his mental illness.

Yet people always bash solely one party in any type of accident. Ironic ain't it?

What kind of bullshit is that? Everybody on the news sites been bashing the homeless guy...

Anyway, according to the report, the TO did not stop until the next station after knowingly seeing the guy.

Thanks for the heads up. I'm reading it now from the Daily News, the T/O clearly did not stop: http://www.nydailynews.com/new-york/homeless-man-hit-train-manhattan-awarded-1-9-million-article-1.1593514#ixzz2rpDy5ZeH

“None of this matters,” Bernstein said, noting that the train’s operator waited until pulling into the next station before reporting the accident. “If you see someone on the tracks you have to stop.”

The jury agreed, finding the New York City Transit Authority 40% at fault for the incident, at the 33rd St. Station in Midtown."

Totally with you on this one.
