EE Broadway Local Posted May 5, 2010 Share #1 Posted May 5, 2010 Homepage / Phoenix News Judge: Auto Shop's Duty Is Limited Posted: 2:12 pm MST May 4, 2010 Phoenix -- An Arizona appellate court ruling in a case stemming from a serious automobile accident effectively says you aren't entitled to what you don't pay for. A State Court Of Appeals panel on Tuesday upheld a trial judge's ruling in favor of a Phoenix oil-change shop that's part of the Jiffy Lube chain. The shop was sued by a man who was paralyzed when the vehicle he was driving overturned several weeks after getting it serviced. The man's lawsuit contends that the shop's worker should have spotted uneven wear on the car's tires and alerted him. The Court Of Appeals said the man didn't pay for a seperate safety inspection, and that Jiffy Lube had no legal duty to him in connection with allegedly worn tires.
